Today is Tuesday, May 3, 2022. Today the country is reeling from a leaked initial draft majority opinion written by Justice Samuel Alito, a flaming right-wing extremist, as reported by Politico last night, that overturns a 50-year precedent in Roe v. Wade. This opinion would also overthrow a 1992 decision of Planned Parenthood v. Casey, which reaffirmed a woman’s right to choose. In his opinion which is not the final decision, Alito wrote, “We hold that Roe and Casey must be overruled.” He misguidedly writes, “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.” There is a reported 23 states planning to ban abortion if the landmark case is in fact overturned, which would result in women losing the right to choose how or when they are pregnant.
This abominable looming decision by a court so extreme in its composition because of “Bitch” McConnell’s and a former president’s machinations is way out of sync with the rest of America. In an article on my smartphone in Wonkette by Robyn Pennacchia entitled “Legal Abortion Is Very, Very Popular . . . And The GOP Knows It,” the statistics behind this 50-year statue are provided. Legalized abortion is one of those liberal policies that is supported by a majority of actual Americans, whereby 70 percent of Americans do not think that Roe v. Wade should be abolished. As a further breakdown, 61 percent believe abortion should be legal in all (27 percent) or most (34 percent) cases. “Only 12 percent believe it should be illegal in all cases.”
instead of worrying about this 50-year precedent being overturned possibly over the end of June, repugnicans are fretting about how terrible it is that someone undermined the sanctity of the Supreme Court in order to leak the draft opinion. Fuck that, I say. The Supreme Court has been undermined for a very long time since the Orange Blob got his stubby, small hands into getting his like-minded conservative jurists appointed and other federal judges confirmed during his one impactful term in office.
The repugnicans quickly began wondering last night whether the leak would help Democrats in the midterm elections or that public outcry over the decision – as I’m writing this, spontaneous protests broke out across the country, with one occurring right now in Foley Square in New York – would cause one of the justices to change his or her mind (hell, this is actually good, I feel).
The writer of this piece accurately points out that repugnicans have always upended precedent by stealing two judges on the court right under Democrats’ feet, with “Bitch” McConnell’s torpedoing of Merrick Garland during Obama’s final year in office and the dance over the grave of liberal jurist Ruth Bader Ginsburg to appoint an antiabortion supporter in the form of Amy Coney Barrett.
Bitch McConnell got his position raked over the coals when this 80-year-old menace to society lashed out at the leaked report, calling it a “stunning breach” and an “attack on the independence of the Supreme Court.” This former Dumpf toady had the audacity to say that the leak was “yet another escalation in the radical left’s ongoing campaign to bully and intimidate federal judges and substitute mob rule for the rule of law.” I’m glad that users on Twitter were quick to fob criticism back at this doddering old man.
This response by the former Senate Majority Leader is covered in an online article in The Daily Dot by Jacob Seitz entitled ‘Get bent’: Mitch McConnell dragged over statement in response to Roe v. Wade leak.”
One user reminded McConnell that “The leak came from the Supreme Court, and you are criticizing the leakers, so if anyone is “attacking the independence of the Supreme Court,” it’s you,” the irate user wrote. Also, he said, for McConnell to “get bent.”
Another user pointed out the hypocrisy of McConnell’s statement, noting that McConnell himself attacked the independence of the court by refusing to allow former President Barack Obama to fill a Supreme Court seat in his final year as president. The “Grim Reaper,” as he was once referred to when he held the reins of power in a happier time for him, but not for the rest of America, called the decision “one of my proudest moments.” This son-of-a-bitch even called for an investigation into the leak. This while he’s still not indicating his position about a real insurrection that occurred while he was a sitting lawmaker on January 6.
All Americans should fight against this attack on women’s reproductive rights because who knows what is next on this court’s agenda. Maybe the erosion of LGBTQ+ rights and other long-fought-for rights that like birth control could be put on the table for dissolution. Everyone should be indignant over what could be the law of the land sometime in the near future.
Another person who believes that this leaked draft opinion is egregious is Chief Justice John Roberts who called its disclosure a “betrayal” and said the Marshal of the Court will investigate how it came about. Roberts’ opinion about the breach of privacy with respect to the leak of Alito’s initial draft opinion is covered in an online CNN article by Joan Biskupic, CNN legal analyst and Supreme Court biographer entitled “An earth-shattering moment for a Supreme Court already on the brink.”
The article mentions that the developments concerning last night’s explosive leak may prove to be a disaster for this already tottering high court that has seen its legitimacy questioned in the last few years. It appears that Politico, the organization that published the opinion, had somehow surmounted the court’s longstanding protocols of secrecy and security.
The extraordinary episode might sow distrust among the justices and could affect negotiations on other pending cases set to be resolved by late June. “The court’s integrity was already on shaky ground, with its public approval rating in record decline.”
The now conservative supermajority on the nine-member bench has raised calls for significant change to the court as in adopting a formal ethics code in light of the Clarence Thomas imbroglio involving his crazy far-right wife and her involvement with the attack on the Capitol on January 6 to expanding the number of seats to offset the far-right dominance, which President Biden has failed to signal his determination to do this thus far.
“The new breach of court secrecy may initially cause the justices to close ranks, as they often do in the face of external scrutiny and criticism.”
Abortion rights in this country date back to 1973, when the high court by a 7-2 vote declared that a constitutional right to privacy, rooted in the Fourteenth Amendment, covered a woman’s right to end a pregnancy. That core right was reaffirmed in 1992 when the principle that states could not interfere with a woman’s ability to obtain an abortion before a fetus could survive outside the womb, at about 23 weeks, was solidly reasserted. At that time, even justices who had criticized the ruling said it was important to adhere to the precedent, for institutional reasons and because, quite simply, Americans had come to rely on it.
That reliance on this precedent is not in effect among the new justices on the court right now, it seems, as they attempt to eviscerate the right to terminate a pregnancy for all women. Quite shocking, I would say. Again, this is not the final ruling by the court, so who knows what might be decided by late June when the court does release its ultimate decision.
All I can say is that repugnicans must be defeated at every turn for their smashing of women’s reproductive rights and the possible destruction of other hard-won rights. How could any repugnican win any local or state contest after this explosive revelation?
Also that idiot Susan Collins of Maine cannot believe that Justices Neil Gorsuch and Brett Kavanaugh would lie to her during their hearings that they would uphold such judicial precedents as abortion rights. What a total boob is this Congresswoman who gullibly believed the lies of two Dumpf’s appointees!
Even President Biden weighed in on this startling draft opinion, calling the ruling “radical” and pointed to its potential domino effect on other rights, including same-sex marriage. If this does happen, I will tell you now that I will be out on the street, along with my compatriots, to denounce this proposed measure.
Now is the time to shout the words of that great fictional character, Howard Beale, of Network: “I’m as mad as hell and I’m not going to take this anymore!” to the rooftops. The moment has arrived when we finally push back at this revolting far-right minority that is being ceded too much power over the majority of Americans!! We’ve had enough!
