Coronavirus Diary

Today is Wednesday, 21, 2022. The news was horrible for Trump World today as two significant defeats were announced against the former Criminal-in-Chief. The first one could destroy the Trump Organization altogether, as New York Attorney General (whom the Orange menace once inexplicably called a “racist”) Letitia James announced a $250 million lawsuit against Dumpf himself, three of his adult children, and the Trump Organization, alleging they were involved in an expansive fraud lasting over a decade that the former “president” used to enrich himself.

The second piece of bad news involves a federal appeals court that has ruled against Trump and his incompetent team of lawyers stating that the Justice Department is now able to continue to examine the documents seized from the autocrat-in-training’s Mar-a-Lago home and resort. This decision can be considered a stunning rebuke of that federal judge in DeSant-ASS’s state that favorably supported Dumpf’s position in ruling for him in that expertly flawed decision handed down a week or two ago. How will this guy sleep tonight, we wonder.

This sweeping lawsuit is examined in an online article for CNN by Kara Scannell, Tierney Sneed, Marshall Cohen, and Hannah Rabinowitz entitled “New York attorney general files civil fraud lawsuit against Trump, some of his children and his business.” The lawsuit is so expansive that it spans 200 pages of documented incidences of fraud against the state. James alleges that the fraud touched all aspects of the Trump business, including its properties and golf courses. “According to the lawsuit, the Trump Organization deceived lenders, insurers, and tax authorities by inflating the value of his properties using misleading appraisals.”

During her stunning press conference in which she announced the humongous lawsuit, James stated, “This conduct cannot be brushed aside and dismissed as some sort of good-faith mistake. The statements of financial condition were greatly exaggerated, grossly inflated, objectively false, and therefore fraudulent and illegal.” She forcefully added, “And as a result of that, we are seeking relief, and Mr. Trump, the Trump Organization, his family – they should all be held accountable.”

Dumpf and his children, Donald Trump, Jr., Eric Trump, and Ivanka Trump are named as defendants in the lawsuit. They have now all been ensnared in the web of justice. Let’s see if they can wriggle out of this one. Allen Weisselberg, former CFO for the Trump Organization, and Jeff McConney, another longtime company executive, are also named.

In addition to filing this major lawsuit, James said she believes state and criminal laws may have been violated and referred the matter to the U.S. attorney’s office for the Southern District of New York and the Internal Revenue Service.

As part of the lawsuit, the attorney general is seeking $250 million in allegedly ill-gotten gains and to permanently bar Dumpf and the children named in the deposition from serving as the director of a business registered in New York State. She is also seeking to cancel the Trump Organization’s corporate certificate, which if granted by a judge, could effectively force the company to cease operations in New York State. This is awesome!

As you would expect, Dumpf and his minions denounced James and her lawsuit, calling it “political.” What else is this criminal going to say when he has finally been caught?

The attorney general launched her investigation into Dumpf’s business way back in 2019 after Dumpf’s former fixer and personal attorney Michael Cohen testified before Congress alleging that Dumpf inflated the value of certain assets to obtain loans and insurance and undervalued others to gain tax benefits.

Today on TikTok, Cohen responded rather giddily to the news of James’ extensive lawsuit, saying that he is available at any time to speak with James and her representatives about his erstwhile boss. He was positively shouting the news. He was also interviewed by CNN’s Victor Blackwell for “Newsroom,” where he said that the allegations in James’ lawsuit represent a “complete destruction” to Trump’s image as a wealthy self-made businessman.

Cohen assessed the fragile ego of his former employer, saying, “It’s like a nuclear bomb exploded. The man has a fragile ego, which we all know. His entire life is predicated on his net worth and him portraying himself as this wonderful businessman, this massive success, this incredibly wealthy guy. And what do we know? We know that it’s not true,” he said.

In addition to the new fraud lawsuit, the business organization is going on trial next month on charges it was engaged in a 15-year tax fraud scheme and its longtime chief financial officer has agreed to testify against the company. This can’t be good for the fragile Orange Menace.

Weisselberg, who served as CFO at the Trump Organization for decades, pleaded guilty in August to his role in a 15-year-long tax fraud scheme, and as part of the deal, he had agreed to testify against Dumpf’s real estate company at trial. This should be a lollapalooza of accusations emerging during that trial.

If anyone thinks Dumpf’s children were innocent in this longterm fraudulent scheme, James torpedoes that notion by saying Eric Trump, Ivanka Trump, and Donald Trump, Jr., “knowingly participated” in the alleged fraudulent plots, the lawsuit states. The alleged scheme “required the participation of Mr. Trump and his children,” the lawsuit said, adding that the children were “aware of the true financial performance of the company.”

One of those instances in which one of the Dumpf’s children was involved in the fraudulent scheme is the citing of Eric Trump being involved in an approach to appraising properties in Las Vegas in a way that lowered their value for tax purposes while inflating their value on Dumpf financial statements.

Ivanka Trump was no naif either, as she is cited as being involved in securing a loan for purchasing the Doral golf course in Florida and Chicago properties in 2012 – loans that James claims were extended in part of financial statements allegedly containing misrepresentations.

The lawsuit alleges, “On each of those transactions with Deutsche Bank, Ms. Trump was aware that the transactions included a personal guaranty from Mr. Trump that required him to provide annual Statements of Financial Condition and certifications.”

What could result in a higher judgment against the Dumpf Organization is the recent testimony provided by Dumpf himself and his son Eric when they were deposed by the attorney general’s office as they were nearing the end of their investigation and both men asserted their Fifth Amendment right against self-recrimination. The fact that both of these clowns took the Fifth can influence the jury hearing this significant case in which they can draw an “adverse inference” against them for not answering questions truthfully and properly. They are damned now!

This state can now applaud Ms. James’ bold move taken against the Trump Organization, which was allowed to conduct its schemes on investors, banks, and other providers with impunity for over 30 years. It is way beyond overdue for there to be accountability with respect to Dumpf and his similarly lawlessly influenced children.

The second piece of bad news for the former Criminal-in-Chief came with the decision of a federal appeals court that is allowing the Justice Department to continue its examination of documents marked as classified that were taken in that raid by the FBI on Mar-a-Lago.

This quick emergency intervention by the court upends Eileen Cannon’s ridiculous order over these documents that had blocked federal investigators’ work on the documents and is a very strong rebuke of the Dumpf team’s attempt to suggest without evidence that materials were somehow declassified. I just heard the Orange Clown stupidly assert in some Fox News interview that just by thinking, he could declassify materials. It’s like I can wiggle my nose and make a rabbit appear out of thin air!

The ruling was issued by a three-judge panel of the 11th Circuit Court of Appeals – two of whom were nominated by Dumpf himself. So he can’t assert now that it was a “partisan decision.”

The 11th Circuit resoundingly rejected Dumpf’s arguments that he may have an interest in classified records that he could keep them from federal criminal investigators. How could he when he is an ordinary citizen now? Anyone without a law degree knows that!

The ruling states in part, Trump “does not have a possessory interest in the documents at issue, so he does not suffer a cognizable harm if the United States reviews documents he neither owns nor has a personal interest in. Second, we find unpersuasive Plaintiff’s insistence that he would be harmed by a criminal investigation.” This was another absurd claim made by the Orange Clown that was shot down by the court.

The court also recognized the real harm posed to the United States if the Department of Justice were to be prevented from continuing its ongoing examination of the materials seized from Mar-a-Lago. The court wrote, “An injunction delaying (or perhaps preventing) the United States’ criminal investigation from using classified materials risks imposing real and significant harm on the United States and the public.”

All in all, this was not a good day for the former demagogue in the White House. Could we dare to hope for that orange jumpsuit to become more of a reality in the near future? If this were not to materialize, could we hope that Dumpf et al. be reduced to penury as a result of James’ massive lawsuit?

Is it too early to open a bottle of champagne here?

Anyway, this is an ongoing story, so let’s see where it winds its way through the deceptive underbelly of the Dumpf Organization. How can repugnicans still support their guy after this massive blow to his business organization? It’s just fitting that the place to undermine Dumpf is the city that made him. Not Florida, not Washington, not any other city but New York!

By the way, we did get our new bookcase put together by “Mr. Dirchman” who came to us as early as 9:30 or so. He had only to put on the bookcase’s legs and to put on the shelves. He must have worked for about an hour this time, not the three hours he put in yesterday. I then put back all of the books on the shelves after I returned from my comic book store. I tried to count them this time, but got interrupted by someone texting me in the middle of the counting, so I gave up. I stopped at 110, I believe. So I would guess that this bookcase holds over 200 books or more.

Stay safe and be well.
