Today is Monday, July 1, 2024, the day that the rogue “Extreme” Court ruled that the insurrectionist known as Donald J. Duck may claim immunity from criminal prosecution for some of the actions he took as president before leaving office, which will likely delay his federal election subversion trial related to his heinous actions on January 6 even further. This is a fucking irrational decision on the part of this out-of-control court that runs counter to the principles that this country has been founded on.
This appalling opinion rejects a decision from a federal appeals court in February that found the former president enjoyed NO immunity for alleged crimes he committed during his presidency to reverse the 2020 election results. Now it’s almost certain that no trial will get under way before the November election since this stinking majority opinion from Chief Justice John Roberts left many technical questions unresolved.
Enough of this terrible decision, what is important that the court’s three remaining liberal justices pulled no punches in excoriating the decision rendered by their fascistic right-leaning colleagues, with two written dissents criticizing the majority opinion as an appalling affront to the nation’s long-held principle that no one is above the law. One of those dissenters, Justice Sonia Sotomayor, wrote that that principle was erased by a ruling that means in “every use of official power, the President is now a king above the law.”
In an online CNN article by John Fritze, Tierney Sneed, and Devan Cole entitled “Takeaways from the Supreme Court’s historic decision granting Donald Trump immunity,” the harrowing implications of this perverted decision on the power of the presidency is detailed within.
Roberts himself seemed to concur with the principle that no one is above the law when he wrote, “The president is not above the law.” However, he dilutes this argument, writing inexplicably, “But Congress may not criminalize the president’s conduct in carrying out the responsibilities of the executive branch under the Constitution.” Huh! Now he counters what he just said by writing the president’s conduct is above the law.
One reality of this decision is that the worst president of this country got a bigger win than expected. For starters, the Supreme Court ruled that for “core” presidential activity, Dump has the absolute immunity he had sought. The majority said that Dump’s conversations with the Justice Department – his efforts to try to get officials on board with his effort to overturn the election – were covered with absolute immunity. How in God’s good earth is this a fair decision, given how unhinged Drumpf is? This fucking decision makes it even more imperative to reject this bastard at the ballot box.
We have Sotomayor who listed “nightmare scenarios” involving illegal conduct by a future president that would, she argued, be shielded from criminal prosecution under the court’s ruling. “Orders the Navy’s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune. Immune,” she wrote.
The liberal justice took the rare step of reading her dissent from the bench today in a move that underscored how aggrieved the liberal bloc of the court is. “With fear for our democracy, I dissent,” she strongly wrote at the end of her 30-page dissent.
Newly minted Ketanji Brown Jackson penned a solo dissent in which the court’s newest member said the majority ruling “breaks new and dangerous ground” by granting immunity “only to the most powerful official in our government.”
The bottom line with this unprecedented decision is that Dump has received more support from his new enablers, members of the highest court in the land.
With this unfair opinion, it was Roberts who repeatedly framed the court’s decision as one made for posterity rather than any single president. But the American people will definitely not read it as such, even as he wrote the immunity the court found, “applies equally to all occupants of the Oval Office, regardless of politics, policy, or party.” I would opine that many Americans will view this decision as only applying to and aiding the convicted felon known as Donald Duck. This will be viewed as only a partisan decision on Dump’s behalf by millions of Americans invested in this matter.
David Cole, national legal director of the American Civil Liberties Union who has repeatedly argued before the justices, said, “On purely partisan lines, the Supreme Court today for the first time in history places presidents substantially above the law.”
I won’t even mention what turncoat Justice Clarence Thomas said about the legitimacy of Jack Smith as a special counsel appointed by Attorney General Merrick Garland. This is a justice who should have recused himself in this issue, but didn’t.
All I can say is that this court’s ruling today makes it much more imperative now not to send Herr Drumpf back to the White House in November. It would be even more of a disaster if this happens, given how this extreme court ruled in his fucking favor.
As expected, President Joe Biden delivered a scathing rebuke of today’s Supreme Court decision, blasting it and saying it does a “disservice” to the American people.
Can this election cycle get any worse after these events? I can’t fathom how much lower it could go between now and November.
