Today is Monday, August 25, 2024. Here he goes again! Former insurrectionist and adjudicated sexual predator and twice-impeached president Donald J. Drumpf is at it again with trying to steal American votes from where they are originally intended and Democrats this time will have nothing to do with it. In an online CNN article by Fredreka Schouten and Tierney Sneed, this new initiative by Democrats is discussed in “Democrats sue to block new GOP-backed Georgia election certification rules.”
I’m hearing about this case from Rachel Maddow on her program tonight. This attempt by ugly repugnicans now in the state of Georgia where Drumpf has been accused of election interference has been met with “ferocious pushback” from Democrats. So now Democrats, with the backing of Kamala Harris’s presidential campaign, sued to block controversial new election rules in the Peach State that they warned could lead to postelection “chaos” in the presidential battleground state in November.
The lawsuit, filed in Georgia state court by the Democratic National Committee, the Georgia Democratic Party and Democratic members of several county election boards, takes aim at two rules passed recently by the Georgia State Election Board that allow election officials to conduct a “reasonable inquiry” before certifying election results and permit members of county election boards to investigate ballot counts.
This lawsuit marks a significant escalation of a controversy that has been brewing for weeks over the action of three Dump-backed repugnican members of the state elections board, who won praise from the convicted felon for their bold – and possibly illegal – moves.
As you might recall, Dump lost Georgia by just over 10,000 votes in 2020, and it was the center of his attempt to overturn the election with claims of voter fraud, though none was found.
Democrats are seeking a court ruling that makes perfectly clear that election superintendents do not have the discretion to delay the certification of election results or to refuse to certify the results altogether.
They are asking for the court to declare that “absent a valid judicial order to the contrary, election superintendents must certify the results of the November 5, 2024 election no later than 5:00 P.M. on November 12, 2024.”
As if anyone needs proof that these three relatively unknown repugnicans are working only to please the Orange Turd, there’s the unwavering fact that the Hannibal Lecter lover mentioned them by name at one of his recent rallies in Atlanta.
The mention by Dump raised red flags for critics of the new board who believe the state elections board’s GOP members are working – officially or not – to appease the former president who has made Georgia a target of his false claim of massive voter fraud.
Georgia state Democrats and voting rights advocates are calling on GOP Governor Brian Kemp to investigate the Republicans on the state elections board. Those election board members are Janelle King, Rick Jeffares, and Dr. Janice Johnston who are accused of breaking state law by pushing the rules changes so close to the general election.
State Senator Islam Parkes has said, “The state elections board does not exist to help Republicans win elections or enrich its members.” I am very grateful that Democrats are not going to take this bullshit from repugnicans a second time and we all have Donald Fuck to thank for this early attempt to subvert an election that hasn’t even taken place yet! Why isn’t this man in jail yet?
Today in reviving the classified documents case against the criminal defendant known as Donald Duck, special counsel Jack Smith has appealed the decision by that odious judge Aileen Cannon who dismissed it last month, thus infuriating many Americans. This new development by the Justice Department is covered in an online article by Katelyn Polantz and Tierney Sneed entitled “Justice Department seeks to revive Trump documents case and defends role of special counsel.”
In a brief filed with the 11th U.S. Circuit Court of Appeals in Atlanta today, Smith argues that Cannon’s decision to end the Drumpf case because the prosecutors’ office lacked constitutional authority was “novel” and “lack[ed] merit.”
Cannon had ruled the Justice Department didn’t have the ability to appoint or fund special counsels like Smith, which is pure bullshit.
Smith’s team also cast the decision from Cannon as not just affecting other special counsel prosecutions – of which there are several ongoing in other courts, against Trump and Hunter Biden, among others – but also as potentially affecting the power of leaders across the federal government.
The 11th Circuit is reviewing the determinations by Cannon that Smith’s appointment as special counsel was unconstitutional and that his office was being unlawfully funded.
The Trump-leaning judge dismissed the charges on that rationale after months of wrangling over other pretrial issues in the classified documents case, and she had not resolved other major legal questions about the prosecution before she tossed it.
Her July 15th ruling leaned on a concurrence written by – who else? – Justice Clarence “Moneybags” Thomas earlier that month in the Supreme Court’s presidential immunity case. Then the “Extreme” Court ruled Dump has presidential immunity that shields him from at least some parts of the case. This ruling from a rogue court succeeded in infuriating so many Americans who feel that Dump still hasn’t experienced any accountability for his many crimes. But here Thomas the poster boy for bought justices by billionaires wrote separately to also question the constitutionality of Smith’s appointment. Here he should have recused himself from making any kind of decision on Drumpf’s behalf, but he didn’t.
In a statement, Dump campaign spokesperson Steven Cheung said all of the charges against Drumpf in various states should be dismissed. Like Hell, they shouldn’t!
This echo chamber of his Orange Turd boss quickly added, “As we move forward in Uniting our Nation, not only should the dismissal of the Lawless [it sure ain’t!] indictment in Florida be affirmed, but be immediately joined by a dismissal of ALL the Witch Hunts.” This is Dump talking. Anything that is lawful he dismisses as a fucking “witch hunt.”
Even though the Atlanta-based appeals court that will decide whether the case can be reinstated has a conservative bent, but it has ruled against Cannon in the past regarding the initial stages of the documents investigation.
What will annoy many of us is that questions over the special counsel’s authority could then land before this Supreme Court, which would result in more delays.
But the Department of Justice’s brief today appears to indicate that prosecutors are already looking toward a possible round of defending the Drumpf case and their office before the Supreme Court. They reach back decades and cite, for instance, a 1998 writing by now-Justice Brett Kavanaugh, who nodded to a “deeply rooted tradition” of independent prosecutors in American history.
The Justice Department even cites the well-known investigation of Richard Nixon where the federal court upheld it. The brief on Monday also pointed out how attorneys general used outside prosecutors after the Civil War for cases including the treason proceeding of Jefferson Davis and another case against a man for assisting in the assassination of Abraham Lincoln.
Let’s hope the 11th Circuit rules quickly in favor of Smith’s reinstating this most serious criminal case against the convicted felon. He should not go scot free.
Now I have to see if I can extricate Atticus from the other side of the kitchen cabinets where he might not have a clearcut path to getting down. He just discovered this new Mount Everest. I also witnessed him jumping from atop of the refrigerator to the top of the kitchen cabinets on the other side. Whoo! He might have to sleep there tonight. I might also have to take the step stool to get him down. Let’s see.
